General

• The designer has the right to refuse any project/commission request.

• Upon payment, the client agrees to the Terms of Service and a copy will be attached to the invoice.

• Anything in the Terms of Service can be discussed with the designer and adjusted for the client’s project prior to any payment.

• By default, the design process may be streamed live on Twitch (twitch.tv/pegazisk) as well as teased on social media. Full privacy after project completion may incur additional fees and the client must notify the designer of any restrictions prior to any payment.

• All projects are handled as digital goods, meaning no physical items will be shipped.

• You will be receiving a digital file only (ie. no physical product) By default, all static project files are delivered to the client via email as .png images. It is then the client’s responsibility to save and store any project files.

• Pricing is subject to change without notice, and you will be charged according to the prices applicable at the moment of confirmation of your commission request (ie. If I quote you and you decide to commission a few months later, prices may have changed and the quote will change accordingly)

• I cannot make major changes that would change the composition of the piece at the WIP check-in (ex. perspective, sitting to standing pose, front view to back view, etc.) if it has not been requested in the initial commission application. Small revisions keeping within the same visual direction are included with all projects but encouraged to be kept concise. Large or extensive revisions may incur additional fees. This is to be assessed by the designer in each case.

Payment

• All prices + payments are in USD($).

• All payment is made through PayPal invoicing.

• Full payment should be made upfront. Invoice totals over $100 can be paid 50% upfront, with the remaining 50% due before the delivery of any final files.

• Rush order can be requested to push your commission to the top of the queue (additional 50% of the total commission price)

• I will send the first sketch for revisions, and a final rough coloured sketch for colour revisions. Cancellations after the first sketch will warrant no refund, further revisions after the first two may be charged extra

• Prices are non-negotiable (but tips are always appreciated!)
  

Copyright + Terms of Use

• By default, the designer retains all rights to the designs and allows the client to use the designs for their intended purpose only.

• The client must credit the designer by username (Pegazisk), Twitter handle (@pegazisk), or website url (pegazisk.com) in the relevant places when the designs are shared or displayed publicly.

• The client does not have the right to repurpose, redistribute, or modify any of the design work.

• If the client purchases any editable project files (.psd, .ai, etc.), they will be able to modify the designs for themselves but still cannot repurpose or redistribute them unless communicated and agreed on with the designer prior to any payment. These extended rights can be refused or will be quoted and charged accordingly.

• I may post your commission on my galleries (if you don't want your commission to be online the client must notify the designer!)

• By commissioning me, you state that you are the rightful owner of the characters that you are commissioning OR In the case of fan art, you agree that you will not use the commission for profit

• If you wish to use my art commercially or on other projects, please specify in your commission. These extended rights can be refused or will be quoted and charged accordingly

  You may:

• Use the image for your icon, header, and background on social media (The client must credit the designer by username)

• Use the image as backgrounds for personal devices

• Share the image on your social media (The client must credit the designer by username)

• Print it for personal use only

  Do not:

• Print the commission to make merch or sell in any way

• Trace over the commission

• Edit the commission (this does not include cropping when using as an icon, for example) - this does not include purchased editable files for modification

Failure to comply with one or several of the above clauses may result in permanent blacklisting.
